Why Do Death Doulas Need Liability Insurance?

Even though your services are entirely non-medical, providing care during times of intense grief and emotional stress can sometimes lead to complex misunderstandings. Independent doulas require dedicated protection for several critical reasons.

In emotionally charged situations, grieving family members may misunderstand your role or take issue with the guidance provided.

  • Claims of Negligence: A family member might claim your non-medical guidance or planning services caused the client or family emotional distress.
  • Misinterpretation of Role: Because death doulas work alongside medical hospice teams, professional liability protects you if you are accused of stepping outside your scope of practice, even if the claim is completely unfounded.
  • Vigil & Care Planning Disputes: Protects you if disputes arise over end-of-life plans, legacy projects, or vigils you coordinated.

Your work is highly mobile. You transition between client homes, hospitals, nursing homes, and hospice facilities.

  • Slip-and-Fall Incidents: Covers you if a family member or client trips over your bag, a therapeutic item, or slips and falls while you are rendering care in their space.
  • Damage to Rented or Client Property: Protects you against accidental property damage claims while you are working in a client's private home or a leased office space.

Products-Completed Operations Aggregate

The maximum amount your policy will pay in a 12-month period for bodily injury and property damage claims that result from the products you use to perform your services.  However, it does not cover products that are sold or distributed.

Damage to Premises Rented to You

This is liability coverage for property damage to a premise for which the insured is liable. This coverage applies to a property the insured rents or has permission to use for 7 days or less. It does not apply to permanently leased locations.

Medical Expenses

Coverage that reimburses others, without regard to the insured’s liability, for medical or funeral expenses incurred by such persons as a result of bodily injury or death sustained by accident under the conditions specified in the policy. This does not apply to the named insured or their employees.

Personal & Advertising Injury

The amount that your policy will pay for claims arising out of one or more of the following offenses:

  • False Arrest, detention or imprisonment
  • Malicious prosecution
  • Wrongful Eviction or Wrongful Entry
  • Oral or written publications that slander or libels a person or organization
  • Oral or written publication or material that violates a person's right of privacy

Defense Costs

Defense Costs coverage is included in your general & professional liability insurance coverage limits. Defense Costs refers to all the costs of defending against a lawsuit. These expenses include the cost of hiring a lawyer, court fees, investigations, gathering facts, filing legal paperwork, and other related costs.
This is often the most important aspect of protecting you if you are being held liable for bodily injury or property damage resulting from your services.
